Company Director - Personal Guarantee liabilities
A businessman with Personal Guarantee liabilities in excess of 450K instructed us to review his Banker/Customer Relationship and the circumstances surrounding the taking of his Personal Guarantees.
We identified various discrepancies in bank formalities, and following negotiatons with his bankers, we obtained the bank's agreement to accept 40K in full and final settlement, and cancelled all his liabilities.

Unauthorised Withdrawals
We recently assisted the Trustees of a Pension Scheme to recover part of the sums that had been improperly withdrawn from the Trustees Bank Account by a former book-keeper.
Some of the funds were recovered from the former book-keeper and from a turf accountant who had accepted the disputed funds. A large sum was recovered from the bank due to their lack of adherance to procedures. We provided guidance to Counsel and Solicitors involved to allow them to present a strong Case against the bank.

London Based Travel Company
Cheques and Bank Drafts were either stolen from company premises or intercepted in course of post to their bank.
The bank denied liability and mounted a robust defenceof their position using high-powered lawyers.
As Expert Consultants for the company, we reviewed the bank's procedures and gave a view on whether the bank had fulfilled its obligations under the Money Laundering Procedures.
The bank then suggested mediation at which the company was awarded the majority of their loss.

Scottish House Builder
A specialist housebuilder in Scotland, enjoyed a good banking relationship for many years when a new Business Manager was appointed.
The relationship soured very quickly and the company re-banked following a period of intense pressure from the bank, including unprofessional behaviour from the new manager to persuade the company to dispose of particular assets and reduce borrowings.
Following our review, a pre-litigation settlement was reached and the bank made a substantial payment.
